Terms of Service
The agreement between CRM For Claims and every company that subscribes to the application.
Last updated: October 21, 2026
These Terms of Service (the "Terms") are an agreement between CRM For Claims ("we", "us") and the company that creates an account (the "Customer", "you"). They cover the CRM For Claims application at app.crmforclaims.com and everything it does (the "Service"). How we handle personal information is described in our Privacy Policy, which is part of these Terms.
Accepting these Terms. You accept them when you tick the agreement box during sign-up or when you use the Service. The person who accepts confirms that he or she has the authority to bind the company. If you do not agree, do not create an account or use the Service.
1. The Service
CRM For Claims is software for managing insurance claim projects: contacts, projects and claims, files and photos, documents sent for electronic signature, tasks and calendars, invoices and payments, reports, and emails and text messages to your clients. The features of each plan are listed on the Pricing page. We improve the Service regularly and may change or retire a feature; if we remove a feature your plan is built around, we tell your administrators at least 30 days ahead. Features labeled as beta are offered as they are and may change without notice.
2. Accounts and users
- Your administrator creates users and decides what each user can see and do through permissions. You are responsible for everything done under your users' accounts.
- Each user has an account of his or her own. Users keep their passwords secret; you tell us at once at info@crmforclaims.com if you think an account was used without permission.
- The information you give at sign-up must be true, and you keep it current.
3. Subscription, renewal and payment
- Price. You pay the price of your plan as shown on the Pricing page and at checkout, plus the fee for each additional active user. Adding a user charges that user's fee right away, prorated to the end of the current billing month; deactivating a user stops the fee and the unused part is credited on the next invoice.
- Automatic renewal. The subscription is billed monthly in advance to the card on file through Stripe, and it renews automatically every month until you cancel it.
- Cancelling. Your administrator can cancel at any time in Settings > Subscription & Billing. Access continues until the end of the month already paid, and you are not charged again.
- Refunds. Fees already paid are not refunded, including for a partial month, unless the law requires a refund or we decide to give one.
- Failed payments. If a payment fails, we email your administrators, and you have 7 days to update the card. After that the account is suspended: only administrators can sign in, and only to the billing page, until the balance is paid. Paying restores access for everyone.
- Price changes. We tell your administrators about a price change at least 30 days before it applies to your next renewal. You can cancel before then.
- Taxes. Prices do not include taxes; you pay any sales or similar taxes that apply.
4. Your data
- It is yours. Everything you and your users put into the Service, including information about your clients ("Customer Data"), belongs to you. You give us permission to store, copy, process and transmit it only as needed to provide the Service, to support you, and to keep the Service secure.
- We act on your instructions. We do not sell Customer Data, do not use it for our own marketing, and do not look at it except to provide or support the Service, to fix a problem, to keep the Service secure, or when the law requires it. We may use statistics that do not identify you or any person to improve the Service.
- Your responsibilities. You are responsible for having the right to collect and use Customer Data, for its accuracy, and for answering the people it is about.
- Getting your data. You can download your files and documents from the Service at any time. When a subscription ends, the account is closed to users and the data is kept so you can reactivate it or ask us for a copy. You can ask us to delete your account and data; we do so within 30 days of the request, except what the law requires us to keep.
- Records the law requires you to keep. Some customers must keep contracts and claim records for years (Illinois public adjusters, for example, for 7 years after the transaction under 215 ILCS 5/1585). Keeping those records, or downloading them before you delete your account, is your responsibility.
5. Electronic signatures
The Service lets you send documents for electronic signature. Before signing, each signer sees an Electronic Record and Signature Disclosure with your company name and contacts and agrees to it, and the Service records each step in a Certificate of Completion. The disclosure is published at app.crmforclaims.com/terms-for-electronic-transactions-and-records.
- You decide which documents to send, and you are responsible for their content and for making sure electronic signature is allowed for them. Some documents, such as wills and certain legal notices, may need paper or another method.
- Where a regulator must approve a form before use (for example a public adjuster contract filed with the Illinois Department of Insurance), you upload only the approved form and keep it current.
- You give paper copies to signers who ask for them, free of charge, and you honor a signer's withdrawal of consent, as the disclosure promises on your behalf.
- You decide whether the way you deliver signing links (email or text message) identifies the signer well enough for your documents.
- We provide the technology and the record of the signing. We do not give legal advice and cannot promise that a court or agency will enforce a particular document.
6. Emails and text messages
- Messages the Service sends to your clients and contacts are sent on your behalf. You are responsible for having the consent the law requires, including under the Telephone Consumer Protection Act and the CAN-SPAM Act, and for the content you write.
- The Service stops optional texts to a number that replies STOP and resumes them after START. You do not try to work around an opt-out.
- We may pause messaging from an account that receives carrier complaints or sends messages that break these Terms, and we tell you why.
7. Your industry's rules
You are responsible for following the laws and licensing rules of your business, including insurance and public adjuster rules, contractor licensing, consumer protection and record keeping. The Service includes tools that help (for example, documents that require a Public Adjuster License can only be sent by a user whose license is recorded and active), but these tools do not replace your own compliance. Nothing in the Service is legal, insurance or tax advice.
8. Acceptable use
You and your users do not:
- use the Service for anything illegal, deceptive or harassing, or to send spam;
- upload malware, or try to reach another customer's data, probe or overload the Service, or get around its security, permissions or limits;
- copy, resell or reverse engineer the Service, or scrape it with automated tools;
- let anyone without a license act as a public adjuster through the Service where a license is required;
- store full payment card numbers in the Service outside the Stripe payment fields.
9. Other services
Some features connect to services of other companies, such as Google Calendar, CompanyCam and Stripe. Your use of them is also governed by their terms, and we are not responsible for how they work. AI intake sends the documents you choose to an AI provider to read them; its results can contain mistakes, so a user reviews them before they are saved.
10. Our property
The Service, its software, design and content belong to us. These Terms give you the right to use the Service during your subscription and nothing more. If you send us suggestions, we may use them without owing you anything.
11. Confidentiality and security
We protect Customer Data with reasonable technical and organizational measures, described in our Privacy Policy, and limit access to the people who need it to run the Service. If we learn that Customer Data was accessed without permission, we tell you without unreasonable delay and give you the information we have so you can meet your own obligations.
12. Availability and support
We work to keep the Service available at all times, but it may be unavailable during maintenance or for reasons beyond our control. Support is available by email at info@crmforclaims.com and by phone at (312) 715-8977 during business hours.
13. Suspension and termination
- You can stop using the Service at any time by cancelling your subscription.
- We may suspend or close an account for unpaid fees (section 3), for a serious breach of these Terms that is not fixed within 10 days of our notice, or immediately when needed to stop harm to others or to comply with the law.
- Sections 4, 10, 14, 15, 16 and 17 continue after the agreement ends.
14. Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES NOT STATED IN THESE TERMS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT IT WILL MEET LEGAL REQUIREMENTS SPECIFIC TO YOUR BUSINESS.
15. Limitation of liability
TO THE EXTENT THE LAW ALLOWS, NEITHER PARTY IS LIABLE FOR LOST PROFITS, LOST REVENUE, LOSS OF DATA OR INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES, AND EACH PARTY'S TOTAL LIABILITY UNDER THESE TERMS IS LIMITED TO THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM. THESE LIMITS DO NOT APPLY TO YOUR OBLIGATION TO PAY FEES, TO YOUR OBLIGATIONS IN SECTION 16, OR TO LIABILITY THAT CANNOT BE LIMITED BY LAW.
16. Indemnity
You will defend and compensate us against claims by others that arise from Customer Data, from the documents and messages you send through the Service, or from your breach of these Terms or of the law, including the costs of defending such a claim.
17. Governing law and disputes
These Terms are governed by the laws of the State of Illinois, without regard to its conflict of laws rules. Before going to court, the parties try to settle a dispute by writing to each other and negotiating for 30 days. After that, either party may bring the dispute only in the state or federal courts located in Lake County, Illinois, and both parties agree to those courts' jurisdiction. Either party may ask any court for urgent relief to protect its property or confidential information.
18. Changes to these Terms
We may update these Terms. For a material change we email your administrators at least 30 days before it takes effect; continuing to use the Service after that date means you accept the new Terms. If you do not accept them, you can cancel before they take effect. The date at the top shows the current version.
19. General
- These Terms, with the Privacy Policy and anything you accept at checkout, are the entire agreement about the Service.
- If one part of these Terms cannot be enforced, the rest stays in effect. Not enforcing a right immediately is not a waiver of it.
- You may not transfer this agreement without our written consent, except to a company that takes over your business. We may transfer it to a company that takes over ours.
- Neither party is responsible for delays caused by events beyond its reasonable control.
- We send notices to your administrators' email addresses; you send notices to info@crmforclaims.com.
